Terms of Service

General Terms:
1. I reserve the right to decline any commission for any reason.
2. The Client must provide clear references, descriptions, and any specific requests before work begins.
3. The commissioned artwork cannot be used for AI training, NFTs, or blockchain-related technologies.
4. I will not accept any NSFW commissions from a minor, no matter the price offered. I am an adult intended creator. If you are commissioning NSFW art from me, I require your ID.Communication:
1. All communication must take place via Email, Discord, or Instagram DMs.
2. The Client must respond to messages in a timely manner. Delays in communication may result in delays in completion.
3. Stay in contact throughout the process for input, if you ghost me before payment your project will be discarded. After payment, you have a one month grace period, if no communication takes place the piece will be either postponed or stored and will not be a priority to finish until you come back. A response will be required before I send the piece over to avoid inactive, hacked or spam accounts.Payment:
1. All payments must be made in USD via PayPal or Ko-Fi. (There are other forms of paying such as Robux, Discord profile decorations, V-Bucks/Fortnite Gifts, or Steam Games.)
2. Payments will occur in full upfront for anything below $30, anything above $30 you will pay in full after you receive a sketch of the piece.
3. Prices are non-negotiable once agreed upon unless the scope of work changes significantly.Refund Policy:
1. Completed artworks will not have any refunds available.
2. Full refunds are only available if I have not started the commission.
3. Mid-progress refunds are not available, make sure you want to work with me 100% before commissioning.
4. All payments are final.Cancellation:
1. The Client may cancel a commission before work begins for a full refund. Once work has started, the refund policy outlined above applies.Process and Delivery:
1. Turnaround time varies depending on complexity and my current workload. Estimated completion time will be provided after confirmation.
2. Progress updates will be provided upon request or at predetermined milestones (e.g., sketch approval, line art, coloring).
3. Final artwork will be delivered digitally in [file formats, e.g., PNG, JPEG, PSD] via [Email, Google Drive, Discord, Instagram, etc.].
4. No physical items will be shipped unless otherwise agreed upon.Revisions:
1. Minor revisions are allowed during the sketching phase at no additional cost.
2. Additional revisions beyond the initial ones, or revisions requested after the approval of major stages (e.g., line art or coloring), may incur extra fees.
3. No revisions will be accepted after the commission is completed and delivered.Copyright and Usage Rights:
1. As the artist, I retain full copyright to all artwork I create, including the right to use it for my portfolio, promotional materials, and social media.
2. The Client receives rights to use the commissioned artwork for personal purposes only (e.g., social media icons, wallpapers), unless commercial rights have been purchased. If you wish to purchase commercial rights, please elaborate and we will discuss prices. You can purchase commercial rights to commissions from me.
3. Redistribution, resale, or modification of the artwork without my consent is prohibited.
4. The Client must credit me (e.g., tagging or mentioning my handle) when sharing the artwork publicly. Do not claim the artwork as your own creation.Liability:
1. I am not responsible for any issues arising from the use of the commissioned artwork outside the agreed-upon terms.
2. Once the artwork is delivered, the Client assumes all responsibility for file storage and preservation.Warnings:
1. Attempts at scamming, chargebacks, reselling of my work, removing of my watermarks or violating any of my Terms of Service will warrant action taken. Do not do this to any artist please, myself and others work hard to create art.
2. Do not REMOVE, COVER, or ALTER my signature or my logo on the art.
3. Stealing, tracing, reselling or claiming that the art I drew for you was created by you will result in you being put on a blacklist from my commissions and being publicly announced that you are not to be served by me. Legal action may be taken depending on severity.
4. My work is not to be sold to anyone ON the blacklist by a different commissioner.

Agreement Acknowledgement
By commissioning me, the Client acknowledges they have read, understood, and agreed to these Terms of Service. Failure to comply with these terms may result in the cancellation of current commissions and refusal of future services.

Copyright & My Branding :Do not steal my work as I have copyright, trademark and legal rights to all my original works.I appreciate all support given to my works, but please do so in moderation. Do not stalk me, impersonate me, or steal my content because you are obsessed with my work. It's really weird and creepy.Inspiration, credits, and writing content MUST be given credits otherwise that is blatantly stealing the work I have gone out of my way to create for people to enjoy. If you are wanting permission to use me as inspiration, you can just ask, a simple text over Discord or an email will suffice, but you cannot STEAL or COPY it. Or ANYONE ELSE'S content if they have explicit request not to.I do not mind people utilizing their own creativity, having similar hobbies, and having fun but I do mind when someone is just going the lazy route and stealing something from someone else. As such, if you are known to do this severely or have stolen content from others, I will block you. I will have a lot to say about theft of my content, and I will escalate matters if I find out my content is being blatantly stolen without my credits.Same for my other works, art, and profiles / appearances. Impersonation will also be met with legal consequences. If the link is not on this card, do not trust it, and do not follow the accounts if they are stealing my content. Please do not steal my art and sell it anywhere, claim you drew it, or repost without proper credits. I work very hard on practicing art and trying to better it, so please don't steal it. Don't do this to me or any other artist. You are able to buy commercial rights and usage from me and if agreed upon it will be totally okay for you to post the art or use it for YT videos, profiles, etc. just with credits somewhere on your page.Please do not use my art for AI training either, I do not care for AI art especially when it is being sold or promoted, AI art is a tool not a replacement for actual art, and I do not want my art being near AI tools. I create my drawings from scratch and they take a lot of time, please do not go the easy route of just dropping it into an AI image generator and using my hard work for a soulless piece.See my Terms of Service in my content section of my carrd for more details on that and my comms. My personal life and creator life are separate.My content is something for a select crowd to enjoy. But I have firm personal boundaries that I will not budge on and have no intention on cutting up for others.

That goes for both my boundaries regarding my content but also my own personal opinions, I do not alter my opinions/advice/conversations to please others, especially if the other is wrong or being harmful to me, themselves, or others. I find the internet is so chalk full of sugar-coated conversations that honesty and real connections are completely jaded through people's entitlement or fear. Just because I am a creator of something does not make me a figure to worship, and I'd rather my conversations outside of comms and requests are honest, engaging and mature. Not filtered to be fake or uncomfortable.I utilize my work for creative and entertaining purposes, I am not here to try and "sell" you something, none of my content is created with the intentions of making someone uncomfortable or to harm. If you enjoy it, great! If not, that is completely fine too. I am here to do my own thing and have set clear boundaries on who is and who isn't supposed to consume certain content and stuff I make. But I will not allow my content to be used as a weapon against me for either good or bad intentions of others. I suggest doing your own research and to be responsible when feeding yourself content and media and practicing media literacy. Adult intended or not. Seek knowledge to better your own experience and yourself as a person.❤︎ Being Responsible -
